MELAKA: A company related to timber works was fined RM15,000 by the Sessions Court here today after being found guilty of dumping commercial solid waste in an unauthorized area in August last year.
The person sued (OKS), Jun Kiat Trading represented by its Director, Tan Choon Kiat, 55, was ordered to pay the fine by Judge Darmafikri Abu Adam after pleading guilty to the charge which was read out by an interpreter in Mandarin.
Based on the charge sheet, OKS has illegally piled controlled solid waste, i.e. commercial solid waste, in an area near housing estates.
The offense was committed at 1.10pm at Lot 26957 Mukim Batu Berendam in the Melaka Tengah district on 16 August 2022.
Convicted, the company can be fined not less than RM10,000 and not more than RM100,000 or imprisoned for not less than six months and not more than five years or both, in accordance with Section 71 (1) of the Solid Waste Management and Public Cleansing Act 2007 and can be punished under Section 71 (8) of the same act.
OKS in its appeal requested a reduced fine on the grounds that it was a first-time offense and that its business was affected during the implementation of the Movement Control Order (MCO).
Prosecuting Officer of the Solid Waste Management and Public Cleaning Corporation (SWCorp), Abd. Hadi Abd. Wahab suggested that a commensurate punishment be imposed taking into account the public interest, the cost of clean-up is borne by the government and the location of the incident belongs to the Federal Land Commissioner.
The court then imposed a fine of RM15,000 and the accused paid the fine. – MESSENGER
